GEOLOGICAL SURVEY DIVISION

NOTICE OF INTENT TO ISSUE A PERMIT AMENDMENT, TECHNISAND, INC., COVERT TOWNSHIP, VAN BUREN COUNTY, pursuant to Part 637, Sand Dune Mining, Natural Resources and Environmental Protection Act (NREPA), for the mining of sand within a Designated Sand Dune Area, at the Nadeau Pit (Permit No. TS-NP-103-A6), located in Section 36, T2S, R18W. This proposed amendment was requested by TechniSand, Inc. on July 16, 2001, to modify Cell Units 1, 2 and 4, and the Plant Site Area of the Progressive Cell Unit Mining and Reclamation Plan (PCUMRP) for the purposes of on-site sedimentation control. The modifications include removal of .571 acres from the plant site area and inclusion of this acreage to the western part of Cell Unit 2, removal of 4.636 acres from the eastern part of Cell Unit 2 and inclusion of this acreage to the plant site area, and removal of 1.605 acres from the plant site area and inclusion of this acreage into Cell Unit 1. The plant site area would be increased by 2.46 acres to 21.560 acres. In addition, the amendment creates a new Cell Unit 2A of 7.58 acres from parts of Cell Unit 2 and 4. The Michigan Department of Environmental Quality (DEQ) will accept public comments to this proposed permit amendment until September 13, 2001, after which time a final decision will be made. The proposed modification to the PCUMRP is on file and available for public inspection at the following locations: DEQ, Geological Survey Division (GSD), Kalamazoo District Office, 7953 Adobe Road, Kalamazoo, Michigan; and DEQ, GSD Office, 735 E. Spencer Township submitted its ordinance regulating the land application of sewage sludge on June 6, 2001. WASTE MANAGEMENT DIVISION

LAPEER COUNTY SOLID WASTE MANAGEMENT PLAN. Consideration of Michigan Department of Environmental Quality (DEQ) issuance of the five-year update to the Lapeer County Solid Waste Management Plan (Plan). The DEQ initiated this round of updates on June 13, 1997. The Plan was written by the DEQ under the authority of Administrative Rule 702(5) of Part 115, Solid Waste Management, Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. WASTE MANAGEMENT DIVISION

FOREST LAWN LANDFILL, INC., THREE OAKS TOWNSHIP, BERRIEN COUNTY. Consideration of a Part 115 Solid Waste Management construction permit application to vertically expand an existing municipal solid waste landfill. Administrative Rules Promulgation

AIR QUALITY DIVISION

PART 55, AIR POLLUTION CONTROL, NATURAL RESOURCES AND ENVIRONMENTAL PROTECTION ACT, 1994 PA 451, AS AMENDED. The Department intends to develop a proposed revision to the air pollution control rules (ORR 2001-059EQ). The proposed amendments to R 336.1101, R 336.1105, and R 336.1113 define the words used in the proposed new rules for start-ups, shutdowns, and malfunctions which are being processed in ORR 2001-040EQ. The remainder of the changes are to bring the Part 1, General Provisions, of the Air Pollution Control Rules up to date with existing statutes and executive orders. AIR QUALITY DIVISION

PART 55, AIR POLLUTION CONTROL, NATURAL RESOURCES AND ENVIRONMENTAL PROTECTION ACT, 1994 PA 451, AS AMENDED. The Department intends to formally adopt proposed revisions to the air pollution control rules (ORR 2001-001EQ) rescinding R 336.1913 and R 336.1914. This rescission is being proposed because the start-up, shutdown, and malfunction rules are not acceptable to the U.S. Environmental Protection Agency (EPA) and prevent the EPA's approval of Michigan's Renewable Operating Permit Program. The proposed rescission can be viewed from the Internet at www.deq.state.mi.us/aqd/rules/proposed%20Amendments.htm. Copies of the proposed rescission may also be obtained by contacting the Air Quality Division, Michigan Department of Environmental Quality, 106 West Allegan Street, P.O. ENVIRONMENTAL RESPONSE DIVISION

PROPOSED ADMINISTRATIVE RULES FOR PART 201, ENVIRONMENTAL REMEDIATION, NATURAL RESOURCES AND ENVIRONMENTAL PROTECTION ACT, 1994 PA 451, AS AMENDED. These rules bring the rules for the state cleanup program under Part 201 up to date with statutory amendments enacted in 1995 and 1996. The rules provide for land use-based cleanup criteria; set forth algorithms for calculation of generic cleanup criteria; explain requirements for remedial action plans and other stages of response activity; clarify which types of response activity require DEQ approval; clarify affirmative obligations of liable persons; and update rules that deal with program administration, such as the inventory of contaminated sites, public funding for the cleanup program, and alternate water service. A public hearing will be held on August 28, 2001, from 1:00 to 5:00 p.m. and from 6:30 to 8:00 p.m., at the Forum Auditorium, Michigan Library and Historical Center, 717 West Allegan, Lansing, Michigan 48909. PUBLIC HEARING ON PERMIT APPLICATION SUBMITTED BY MICHIGAN DEPARTMENT OF ENVIRONMENTAL QUALITY, ENVIRONMENTAL RESPONSE DIVISION, KALAMAZOO DISTRICT OFFICE, KALAMAZOO, MICHIGAN. The Land and Water Management Division will hold a public hearing at the City of Bangor, City Hall, 257 West Monroe Street, Bangor, Michigan. The hearing will be for Permit Application Number 01-80-0022-P, submitted by the Michigan Department of Environmental Quality, Environmental Response Division, Kalamazoo District Office, 7953 Adobe Road, Kalamazoo, Michigan. The applicant proposes to dredge approximately 22,000 cubic yards of contaminated sediment along approximately 800 feet of the Black River. The dredging would impact 314,531 square feet of wetlands. The dredged material would be replaced with sand fill and the riverbank would be stabilized. Five off-channel ponds would result from this clean-up project. DEADLINE FOR PUBLIC COMMENT ON PROPOSED ADMINISTRATIVE RULES FOR PART 201, ENVIRONMENTAL REMEDIATION, NATURAL RESOURCES AND ENVIRONMENTAL PROTECTION ACT, 1994 PA 451, AS AMENDED. These rules bring the rules for the state cleanup program under Part 201 up to date with statutory amendments enacted in 1995 and 1996. The rules provide for land use-based cleanup criteria; set forth algorithms for calculation of generic cleanup criteria; explain requirements for remedial action plans and other stages of response activity; clarify which types of response activity require DEQ approval; clarify affirmative obligations of liable persons; and update rules that deal with program administration, such as the inventory of contaminated sites, public funding for the cleanup program, and alternate water service. DEADLINE FOR PUBLIC COMMENT ON A PROPOSED REMEDIAL ACTION PLAN FOR THE FORMER ITT AUTOMOTIVE FACILITY, ROCHESTER, OAKLAND COUNTY. Written comments are being accepted on a proposed remedial plan for the former ITT Automotive facility, a site of environmental contamination located at 301 East Third Street, Rochester. The site is currently occupied by the Western Knitting Mills redevelopment project. The proposed plan calls for treatment of the groundwater impacting the Paint Creek by a permeable reactive wall to chemically neutralize the contaminants of concern. The plan also includes a monitoring plan for the groundwater to verify compliance with applicable criteria. The plan proposes restrictions on groundwater to prohibit use for drinking water both on the site and other properties potentially affected, and surface barriers of soil cover, pavement, or buildings to prevent direct contact exposure to contaminated soils.
