GEOLOGICAL SURVEY DIVISION

J.B. EXCAVATING, INC., LAKETOWN TOWNSHIP, ALLEGAN COUNTY, NOTICE OF INTENT TO ISSUE A PERMIT AMENDMENT pursuant to Part 637, Sand Dune Mining, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended, for the mining site commonly known as the Laketown Site, (Permit No. BON-LT-115-A). The amendment increases the acreage of the permitted site and modifies the Progressive Cell Unit Mining and Reclamation Plan. The active cell unit configuration changes but remains at a total of 40 acres. No additional mining will be conducted below the water table. Reclamation will be carried out pursuant to a local Planned Unit Development. The proposed modification of the conservation easement would allow the Bay City Public Schools to apply for a permit within the easement area to construct a nature trail and viewing platform for students to access the property and learn about wetlands. STONE RIDGE SUBDIVISION, MIDLAND COUNTY, REQUEST FOR A MODIFICATION TO A CONSERVATION EASEMENT HELD BY THE DEQ. Messrs. Ben Lerner, Richard T. Miller, Lawrence J. Snyder, and Leonard Pershin are holders of an interest on lots located in the Stone Ridge Subdivision, Midland County. The interest holders request a modification to a conservation easement held by the Michigan Department of Environmental Quality, which would impact a total of 0.62 acres of regulated wetland contained on four separate sites on the property. CLARE COUNTY SOLID WASTE MANAGEMENT PLAN. Consideration of Michigan Department of Environmental Quality (DEQ) approval with modifications of the locally approved five-year update to the Clare County Solid Waste Management Plan (Plan). Administrative Rules Promulgation

AIR QUALITY DIVISION

PART 55, AIR POLLUTION CONTROL, NATURAL RESOURCES AND ENVIRONMENTAL PROTECTION ACT, 1994 PA 451, AS AMENDED. The Department intends to develop a proposed revision to the Air Pollution Control Rules (ORR 2001-040EQ). The proposed amendment will provide new rules regarding monitoring, reporting, recordkeeping, and written programs relating to emissions from malfunction, start-up, and shutdown of source processes and/or process equipment. The new rules will be incorporated into Part 9. Emission Limitations and Prohibitions-Miscellaneous, of the Air Pollution Control Rules. PUBLIC HEARING ON PERMIT APPLICATION SUBMITTED BY THE EATON COUNTY DRAIN COMMISSION, CHARLOTTE, MICHIGAN. The Land and Water Management Division will hold a public hearing at the Holiday Inn West Lansing Conference Center, Regency Ball Room, 7501 West Saginaw Highway, Lansing, Michigan. The hearing will be for Permit Application Number 01-23-0003-P, submitted by the Eaton County Drain Commission, 1045 Independence Boulevard, Charlotte, Michigan, to manage discharges and stormwater runoff from Delta and Windsor Townships, Eaton County, and to protect and reestablish natural resources within the Carrier Creek Drain Watershed. The proposed project would impact existing wetland and floodplain areas in the watershed. To mitigate the impact, the proposal includes creation/enhancement of 35.12 acres of wetland and additional floodplain creation/restoration. The Waste Management Division (WMD) will hold a public hearing regarding a draft major modification to the WDI Part 111 hazardous waste operating license on May 23, 2001. CONTESTED CASE HEARING BEFORE THE SUPERVISOR OF WELLS, MIRACLE PETROLEUM, L.L.C., LINCOLN TOWNSHIP, OSCEOLA COUNTY. Cause No. (A) 8-5-01. Petitioner seeks an order of the Supervisor of Wells granting an exception to Special Order No. 1-86 forming a 160-acre drilling unit. Petitioner proposes to drill and complete the Zinger #1-1 well (PN 40137) to a formation between the top and base of the Glenwood Member of the Black River Group. The proposed drilling unit is the NE 1/4, Section 1, T18N, R10W, Lincoln Township, Osceola County. NOTICE OF CHANGE IN PROCEDURE. Effective June 1, 2001, the Land and Water Management Division (LWMD) will implement a change in procedure involving review of applications for permits under Part 31, Water Resources Protection (Floodplain Regulatory Authority); Part 301, Inland Lakes and Streams; Part 303, Wetlands Protection; Part 323, Shorelands Protection and Management; Part 325, Great Lakes Submerged Lands; and Part 353, Sand Dunes Protection and Management, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. Many of these parts contain mandatory timeframes for a final decision; i.e., approval or denial of a permit application. These time limits often make it difficult for LWMD staff and an applicant to complete discussions on a mutually agreeable project modification for which a permit could be issued. As an alternative to receiving a denial, the applicant may withdraw the application prior to the deadline for decision. The applicant can revise the application and request that the LWMD reactivate the application within six months from the date of withdrawal. If the applicant does not withdraw the application before the decision deadline, the LWMD will deny the permit application. An applicant who has received a denial of an application has a right to appeal the denial to the Office of Administrative Hearings through the contested case hearing process. The decision rendered at the conclusion of the contested case process is a final decision of the department. An applicant who has received a denial may also submit a new application with the appropriate fee to have a modified project considered. NOTICE OF JURISDICTIONAL CHANGE FOR CERTAIN WETLANDS IN ALLEGAN AND EATON COUNTIES. The U.S. Census Bureau has released the official 2000 census figures. The population for Allegan and Eaton Counties each now exceeds 100,000, which will significantly change the regulatory status of certain wetlands within these counties. Part 303, Wetlands Protection, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended, requires permits for certain activities in regulated wetlands. Specifically, a permit is required from the Michigan Department of Environmental Quality to dredge or remove soil or minerals from a wetland; to deposit or place fill material in a wetland; to construct, operate, or maintain a use or development in a wetland; or to drain surface water from a wetland. Section 30301 of Part 303 defines regulated wetlands as those contiguous to the Great Lakes; Lake St. Clair; or any inland lake, pond, river, or stream; and as those noncontiguous wetlands larger than five acres in counties with a population of 100,000 or more. The term "contiguous" is defined in the administrative rules promulgated under Part 303. Allegan and Eaton counties have not met the 100,000 population criterion in the past, and noncontiguous wetlands more than five acres in size have not been subject to Part 303 jurisdiction in these counties. Now that the 2000 census has officially established the population in these two counties at 100,000 or more, noncontiguous wetlands more than five acres in size will come under Part 303 jurisdiction. Permits will be required as of July 1, 2001, for all activities described above in noncontiguous wetlands more than five acres in size, in Allegan and Eaton counties, regardless of when the activity began. REGULATIONS 101 – AN ENVIRONMENTAL, SAFETY, AND HEALTH COURSE. The Michigan Departments of Environmental Quality (DEQ) and Consumer and Industry Services (CIS) are offering a Regulations 101 – Environmental, Safety, and Health course at various locations throughout the state. The course is an introduction to environmental, health, and safety regulations affecting Michigan’s manufacturing industry. The textbook, "Michigan Manufacturers’ Guide to Environmental and Safety and Health Regulations," will be provided to course participants. Written by program specialists in the DEQ and CIS, the book is packed full of easy-to-read discussions about state and federal environmental rules. The book also summarizes MIOSHA’s safety and health programs. Cost: $75 which includes continental breakfast, lunch, workshop materials, and copy of the "Michigan Manufacturers’ Guide to Environmental and Safety and Health Regulations." Reduced cost of $50 for those who already have a copy of the Guidebook. NOTE: The Guidebook will be used at this course. MICHIGAN RECYCLING COALITION'S 19TH ANNUAL CONFERENCE, BEYOND 2001: THE GREAT RECYCLING GETAWAY!, BOYNE HIGHLANDS, MICHIGAN. The Michigan Recycling Coalition's (MRC) 2001 Annual Conference and Business Expo includes sessions, tours, and exhibits focusing on recycling and waste reduction issues in Michigan. Highlights include a behind-the-scenes tour on Mackinac Island, in-depth sessions on mercury and electronics, and special presentations by Andy Acho of Ford Motor Company and noted author, Stephanie Mills. DEQ staff will be available to answer questions about topics ranging from household hazardous waste to mercury, county solid waste planning, and composting. This is a unique networking opportunity for recyclers representing Michigan communities and businesses. EAST MICHIGAN CHAPTER OF THE AIR AND WASTE MANAGEMENT ASSOCIATION SPRING CONFERENCE, NORTHFIELD HILTON, TROY, MICHIGAN. The East Michigan Chapter of the Air and Waste Management Association is holding its spring conference; and confirmed speakers include the Office of Air and Radiation Director from the U.S. Environmental Protection Agency’s (EPA) Region 5 office, Genesee County Circuit Court Judge Archie Hayman who ruled on the Genesee Power Environmental Justice case, Mike Kwiecien from Conestoga Rovers who will speak on virtual reality emergency response exercises, and Rad Jones from Michigan State University speaking on critical incident protocol. MICHIGAN DEAL FLOW CONFERENCE - A MARKETPLACE FOR BROWNFIELD TRANSACTIONS, NOVI, OAKLAND COUNTY. The National Brownfield Association (NBA), with the Michigan Department of Environmental Quality (MDEQ), the Michigan Economic Development Corporation (MEDC), and nearly ten co-sponsoring organizations, hosts this Michigan Deal Flow Conference. The full-day conference brings together major players in the brownfield market (owners, developers, transaction support, and public sector) to showcase brownfield properties ready for transfer and stimulate brownfield transactions. PERMIT TO INSTALL WORKSHOP. Michigan Air Pollution Control rules require businesses to obtain an approved Permit to Install prior to installing or modifying sources of air pollution. The Clean Air Assistance Program of the Michigan Department of Environmental Quality’s Environmental Assistance Division is planning the Permit to Install workshop to assist small and medium-size businesses in submitting an air use permit application. Upon completion of the training, participants will be able to assemble the information necessary to achieve an administratively and technically complete application. FREE PRODUCT MOVEMENT AND RECOVERY: THEORY AND FIELD METHODS, EAST LANSING MARRIOTT AT UNIVERSITY PLACE, EAST LANSING, MICHIGAN. The Michigan Department of Environmental Quality’s Storage Tank and Environmental Assistance Divisions present this workshop for Qualified Underground Storage Tank Consultants (QCs) and Certified Professionals (CPs) who perform corrective action under Part 213, Leaking Underground Storage Tanks, of the Natural Resources and Environmental Protection Act, 1994 PA 451, as amended. Additionally, other environmental consultants or state/local representatives who need to understand the migration and recovery of light, non-aqueous phase liquids (LNAPLs) will benefit. The instructor is James M. Davidson of Alpine Environmental, Inc. in Fort Collins, Colorado. Mr. Davidson is a nationally recognized expert and teaches a variety of scientific short courses and workshops addressing MTBE, petroleum products, subsurface contamination, and remediation. The workshop agenda will cover topics such as physical and chemical characteristics, migration, recoverability, recovery methods, and case study examples will be given.
