On
February 29,
2008, the State Office of Administrative Hearings and Rules (SOAHR) approved a
Request for Rulemaking
for a revision to Part 10, Intermittent Testing and Sampling, R 336.2001
and R 336.2004
(Rules 1001 and 1004). The proposed revision is being developed for reporting
mercury emissions in order to meet the Governor's directive to reduce
mercury emission from electric generating units (EGUs) by 90% by 2015.
On May 21, 2008, the proposed rules were submitted to the Legislative Service Bureau (LSB) for informal review. A public hearing was held on October 2, 2008, in Lansing for SOAHR 2005-038EQ (Part 15, proposed mercury emission regulations), 2008-008EQ (Part 10, intermittent testing and sampling) and 2008-009EQ (Part 11, proposed monitoring rules). The public comments received during the public comment period are shown below. On August 3, 2009, the modified rules and Agency Report were submitted to SOAHR for their review. The modified rules were certified by SOAHR and LSB on August 12, 2009 and submitted to the Joint Committee on Administrative Rules on August 13, 2009. On October 16, 2009 the Part 10 rules were filed with the Secretary of State and became effective immediately after filing.
