On
August 8,
2007, the State Office of Administrative Hearings and Rules (SOAHR) approved a Request for Rulemaking
for the revision of
R 336.1802a, R
336.1803, R 336.1821 to R 336.1823, and R 336.1830 to R 336.1833 in Part 8, Emission
Limitations and Prohibitions – Oxides of Nitrogen. The proposed revisions
will address deficiencies identified by EPA in Michigan’s Clean Air
Interstate Rules to reduce NOx from electric generating units.
On March 25, 2008, the proposed rules were submitted to SOAHR for informal
review, and on March 28, 2008, SOAHR approved the Regulatory Impact
Statement. A public hearing was held on June 19, 2008, in Lansing, Michigan. The proposed rules and Agency Report were approved by the SOAHR on April 21, 2009 and were submitted to the Joint Committee on Administrative Rules on April 22, 2009.
