Proposed Amendments to the Air Pollution Control Rules

On June 20,  2007, the State Office of Administrative Hearings and Rules (SOAHR) approved a Request for Rulemaking for the revision of R 336.1940 to R336.1942 and the addition of R 336.1902 and R 336.1943 to R 336.1947 to adopt by reference the most recent  federal Maximum Available Control Technology (MACT) standards.  The Part 9 amendments were filed with the Secretary of State on September 11, 2008, and became effective immediately.

The following is a list of the proposed rules:

  • R 336.1940; Ethylene oxide emissions standards for sterilization facilities.
  • R 336.1941; Chromium emissions from hard chromium electroplating, decorative chromium electroplating, and chromium anodizing tanks.
  • R 336.1942; Asbestos.
  • R 336.1943; General provisions.
  • R 336.1944; Portland cement manufacturing.
  • R 336.1945; Publicly owned treatment works.
  • R 336.1946; Secondary aluminum sources.
  • R 336.1947; Site remediation.
     

In addition, new rules R 336.1970 and R 336.1971 were proposed to provide the regulatory basis and methodology that affected sources must follow to comply with Best Available Retrofit Technology (BART) per federal Regional Haze rules.  BART is part of the federal Regional Haze program for reducing haze-causing emissions in Class I areas.  The two Class I areas in Michigan are Isle Royale National Park and Seney National Wilderness Area.

A public hearing was held on April 14, 2008.  The proposed rules and Agency Report were approved by the State Office of Administrative Hearings and Rules on May 30, 2008, and the proposed rules were submitted to the Joint Committee on Administrative Rules on June 4, 2008.
