Proposed Amendments to the Air Pollution Control Rules

On April 13,  2007, the State Office of Administrative Hearings and Rules (SOAHR) approved a Request for Rulemaking for the revision of Part 18, Prevention of Signification Deterioration of Air Quality (PSD), R 336.2801, R 336.2816, and R 336.2818 (Rules 1801, 1816, and 1818).  The U.S. Environmental Protection Agency has identified a deficiency in the PSD rules.  One of the definitions was unintentionally omitted.  Also, another definition needs to be clarified because the interpretation of the definition as it is currently written does not follow the intent of the definition when these rules were developed.  The Part18 amendments were filed with the Secretary of State on September 11, 2008, and became effective immediately.

A public hearing was held on June 19, 2008.  The proposed rules and Agency Report were approved by the State Office of Administrative Hearings and Rules on August 8, 2008, and the proposed rules were submitted to the Joint Committee on Administrative Rules on August 8, 2008.
