Proposed Amendments to the Air Pollution Control Rules

On May 30,  2006, the State Office of Administrative Hearings and Rules (SOAHR) approved a Request for Rulemaking for an addition to Part 6, Emission Limitations and Prohibitions--Existing Sources of Volatile Organic Compound Emissions, R 336.1640 (Rules 640).  The proposed new rule will limit VOC emissions from process equipment utilized in the manufacture of Portland cement, in areas designated as nonattainment for ozone on June 15, 2007.

Public hearings were held on September 5 and 27, 2007, in Lansing and Dundee.  A total of 260 letters and comments were received regarding the proposed rule.  The DEQ staff is reviewing all comments submitted and will provide a response to those comments. 

On January 5, 2010, SOAHR approved the withdrawal of the RFR.
