Proposed Amendments to the Air Pollution Control Rules

SOAHR 2005-038EQ
On July 3, 2006, the State Office of Administrative Hearings and Rules (SOAHR) approved a revised Request for Rulemaking (RFR) for additions to Part 15, Emission Limitations and Prohibitions--Mercury, R 336.2501 to R 336.2513 (Rules 1501 to 1513).  The proposed new rules are being developed to meet the Governor's directive to reduce mercury emissions from electric generating units (EGUs) by 90% by 2015.  A stakeholder workgroup was formed for the rule development process.  See the following webpage for more information regarding the workgroup:  Michigan Mercury Rules Workgroup Updates & Materials.

On May 21, 2008, the proposed rules were submitted to the Legislative Service Bureau (LSB) for informal review.  A public hearing was held on October 2, 2008, in Lansing for SOAHR 2005-038EQ, 2008-008EQ (Part 10, proposed reporting rules) and 2008-009EQ (Part 11, proposed monitoring rules).  The public comments received during the public comment period are shown below. 

On August 3, 2009, the modified rules and Agency Report were submitted to SOAHR for their review.  The modified rules were certified by SOAHR and LSB on August 12, 2009 and submitted to the Joint Committee on Administrative Rules on August 13, 2009.  The modified rules and Agency Report can be viewed by clicking on the links below.  Also see proposed Part 10, proposed mercury reporting regulations (2008-008EQ) and Part 11, proposed mercury monitoring regulations (2008-009EQ).

On October 16, 2009 the Part 15 rules were filed with the Secretary of State and became effective immediately.
