On January 31, 2008, rules for Part 4, Emission Limitations and Prohibitions--Sulfur Bearing Compounds, were filed with the Secretary of State and became effective immediately.  The final rules and related documents can be viewed by clicking on the links below.

On June 6, 2005, the State Office of Administrative Hearings and Rules (SOAHR) approved a Request for Rulemaking for the addition of R 336.1420 (Rule 420).  The new rule was developed to meet requirements of the U.S. Environmental Protection Agency (EPA) to reduce transported emissions of sulfur dioxide (SO2) from electric generating units (EGUs).  A stakeholder workgroup was formed for the rule development process, and the last meeting was held on August 15, 2006.

On May 1, 2006, the RFR was revised to include new rules, R 336.1401a and R 336.1405 to R 336.1407, to replace the former Wayne County sulfur dioxide rules.  In addition, R 336.1401, R 336.1402, and R 336.1404 were revised.

A public hearing on these rules was held on July 19, 2007.
