Amendments to the Air Pollution Control Rules

On April 25, 2005, the State Office of Administrative Hearings and Rules (SOAHR) approved a Request for Rulemaking for revisions to the regulations for volatile organic compounds, R 336.1627 (Rule 627). The state of Michigan requires that the gasoline delivery vessels be tested between April 1 and June 30.  The amendment requires the delivery vessels to be tested annually using the U.S. Environmental Protection Agency Method 27 as referenced in R 336.2004(u), which is consistent with the U.S. Department of Transportation requirements.  Additional notification requirements have also been added.  Submittal of the test results have been changed from July 15 to within 30 days from the date of the test.  Also, test approval conditions were added.  See also 2005-026EQ for revisions to R 336.2004 and R 336.2005.

On February 22, 2006, the rule was filed with the Secretary of State and became effective immediately. See the final rule, Agency Report, and Regulatory Impact Statement below for more information.
