On February 25,
2004, a Request for Rulemaking

of the Air Pollution Control Rules.
The Part 2 amendments were
filed with the Secretary of State on June 20, 2008, and became effective
immediately. The DEQ proposed to rescind R 336.1220, which will be replaced by new New Source Review (NSR) and Prevention of Signification Deterioration (PSD) permitting rules in Parts 18 and 19. In addition, all relevant citations in the Part 2 rules were changed to reflect the state's new permitting authority in the new Part 18 and Part 19 rules. The State Office of Administrative Hearings and Rules approved the Agency Report and submitted the proposed rules to the Joint Committee on Administrative Rules on December 7, 2007.
