Amendments to the Air Pollution Control Rules

On October 7, 2003, the Office of Regulatory Reform approved a Request for Rulemaking for revisions to the regulations for oxides of nitrogen (NOx), R 336.1802 through R 336.1816.  Some minor revisions to Rules 802, 804, and 811 of the NOx rules are being proposed to address concerns raised by the U.S. Environmental Protection Agency in order to make Michigan's State Implementation Plan approvable.  On March 16, 2004, the U.S. Environmental Protection Agency filed a notice of conditional approval and promulgation of Michigan’s State Implementation Plan for Oxides of Nitrogen, contingent upon the state submitting these final rule revisions by May 31, 2004.

On May 12, 2004, the rules were filed with the Secretary of State and they went into effect on May 20, 2004.  The final rules and Public Hearing Report can be viewed by clicking on the appropriate buttons below.
