Amendments to the Air Pollution Control Rules

ORR 2002-003EQ
On January 10, 2002, the Office of Regulatory Reform (ORR) approved a Request for Rulemaking (RFR) for revisions to R 336.1101, R 336.1103, R 336.1106, R 336.1114, R 336.1116, R 336.1118, and R 336.1119.  The revisions amend definitions related to the New Source Review permit program.  Revisions to the New Source Review permit program were developed under ORR 2002-004EQ.  The NSR rule revisions address program approval issues raised by the United States Environmental Protection Agency, findings of the Office of the Auditor General, and new exemptions from the requirement to obtain a Permit to Install.  A public hearing was held on November 6, 2002.

The rules were filed with the Secretary of State on June 23, 2003, and went into effect on July 1, 2003.  The final rules and Public Hearing Report can be viewed below.
