Amendments to the Air Pollution Control Rules

ORR 2001-001EQ
The rescission of R 336.1913 and R 336.1914 was filed with the Secretary of State on September 4, 2001, and will go into effect on September 12, 2001.

The Request for Rulemaking was approved on January 8, 2001, to rescind R 336.1913 and R 336.1914 relating to emissions from malfunction, start-up, and shutdown of source processes and/or process equipment.  Section 5509 of Act 451 required the adoption of these rules; however, the United States Environmental Protection Agency found them to be in non-conformance with both Section 110 of the federal Clean Air Act and Title 40 of the Code of Federal Regulations, Part 70, requirements for the Title V Renewable Operating Permit Program.  A public hearing was held on May 16, 2001.
